These Terms of Service ("Terms") are a legal agreement between you and ACADIME ("ACADIME", "we", "us", or "our") governing your access to and use of the ACADIME application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use ACADIME. If you are under the age of majority where you live (for example, under 19 in British Columbia, Canada), you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements.
ACADIME helps students organize courses, grades, schedules, flashcards, and study activity, connect with friends, and use AI-assisted features such as the DIME assistant and AI flashcard generation. We may add, change, or remove features at any time, and may set limits on certain features (for example, the volume of AI usage) to keep the Service reliable.
To use most features you must create an account with accurate information, including a valid email address and a unique username. You are responsible for keeping your credentials confidential, for all activity under your account, and for choosing a strong password. Notify us at acadime.app@gmail.com if you believe your account has been accessed without authorization. Usernames must not impersonate others, infringe rights, or be offensive, and we may reclaim or require changes to usernames in appropriate cases.
You agree not to: use the Service unlawfully or in violation of these Terms; upload content you do not have the right to use or that infringes intellectual-property or privacy rights; upload unlawful, harmful, harassing, hateful, or otherwise objectionable content; attempt to access another user’s account or data or circumvent the Service’s security or per-user access controls; probe, scan, overload, disrupt, or reverse-engineer the Service; use the Service or its AI features to violate your institution’s academic-integrity rules; or use automated means that harm the Service or other users. We may suspend or terminate accounts that violate these rules.
You retain ownership of the content you create or upload ("Your Content"). You grant ACADIME a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the Service to you, including sending relevant content to our AI providers when you use AI features. You are responsible for Your Content and represent that you have the rights necessary to upload it. Do not upload copyrighted course materials unless you are permitted to do so.
ACADIME’s AI features use third-party large-language-model providers to generate responses. AI outputs may be inaccurate, incomplete, or unsuitable for your purpose. They are provided for study assistance only and are not academic, professional, medical, legal, or financial advice, and are not a guarantee of any academic outcome. Always review and verify AI-generated content, and use these features in compliance with your institution’s academic-integrity policies.
The Service itself, including its software, design, branding, and the ACADIME name and logo, is owned by ACADIME and its licensors and protected by intellectual-property laws. These Terms do not grant you any right to use our branding without permission. All rights not expressly granted are reserved.
ACADIME is built on and relies on third-party providers, including our application platform Base44 (a Wix company) and AI providers OpenAI and Anthropic. Your use of the Service may be subject to those providers’ terms where applicable. We are not responsible for third-party services we do not control.
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE. ACADIME DOES NOT GUARANTEE ANY ACADEMIC RESULT. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACADIME AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR CAD $50. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless ACADIME and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or of applicable law or third-party rights.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (including Sections 6, 8, 11, 12, and 13) will survive.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Subject to applicable law, the courts located in British Columbia will have jurisdiction over any dispute, though mandatory consumer-protection rights in your place of residence still apply to you.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
